The Virtual Asset and Initial Token Offering Services (VAITOS) Act provides Mauritius's regulatory framework for virtual asset service providers (VASPs) and initial token offering (ITO) issuers. Enacted to align Mauritius with FATF recommendations on virtual assets, the VAITOS Act establishes a licensing regime that provides regulatory clarity, investor protection, and AML/CFT compliance for digital asset businesses. Mauritius is one of a small number of jurisdictions globally to have enacted comprehensive virtual asset legislation, positioning it as an attractive location for compliant digital asset businesses.
Licence Categories
VAITOS licences are available for Virtual Asset Broker-Dealers, Virtual Asset Custodians, Virtual Asset Exchanges, Virtual Asset Transfer service providers, and Initial Token Offering (ITO) Issuers.
AML/CFT Requirements
VAITOS licence holders must implement comprehensive AML/CFT programmes including customer due diligence, transaction monitoring, suspicious transaction reporting, and Travel Rule compliance for virtual asset transfers.
Banking Access
A key benefit of VAITOS licensing is the ability to access banking services in Mauritius. Regulated VASPs are treated as financial institutions for AML/CFT purposes, improving their access to correspondent banking.
ITO Framework
The VAITOS Act provides a regulatory pathway for Initial Token Offerings, requiring an approved prospectus, investor protections, and post-issuance reporting obligations for ITO issuers.
Licensing Process
